Consultant tasks Council boss to obey Court Judgement order over contractual agreement in Abia

Managing Director of Chicotas Nigeria limited, Deacon Uchendu Ahuruonye has tasked  the Transition Committee Chairman of Aba South Local Government of Abia State,Chief Cherechi Nwogu, to obey the Court Judgement  order  given by Abia State High Court  over  the Contractual agreement the LGA  entered with the Company in 2014.

He wondered why an educated LGA Chairman who is a pharmacist by profession will disobey the Abia State High Court Judgement Order with impunity as if he and the Council are above the law.

Deacon Ahuruonye, further called on the Council to the Chief Cherechi Nwogu, to obey the court order and allow his company, Chicotas execute the contract agreement to the letter.

It could be recalled that on 1st January,2014,  during the tenure of Chief David Otumdi Kanu ,Aba South Local Government had entered into an agreement with Chicotas Nigeria limited to collect revenue on behalf of  Aba South LGA for a period of 12 months but sadly  midway into the execution of the  said contract,the  new T C Chairman,Dr NCNC Okoli, breached the contract as  he refused the contractor to execute the contract to the letter by sending his workers to the field to collect revenue,in the process harassed his men while executing lawful contract.

Speaking to Journalists in Aba,the embattled Revenue Contractor noted that Dr Okoli's    administration levelled all manner of allegations and petitions against him to the then Inspector General of Police at Abuja,  he was arrested and detained  but after listening  to his  own side of the story,the police found nothing wanting on him.

Aharaonye, however  proceeded to Court to seek redress on release from detention and  that the matter lasted for four years,was eventually decided in his favour on 26th June,2019 by the Abia State High Court presided by Hon Justice Onuoha Ogwe,the
Chief Judge of Abia State .The judgement order is that Chicotas Nigeria limited has a specific performance for the execution of the contract till 2020 fiscal year.

However,on 10th October,2019 , the MD of Chicotas Nigeria limited served a copy of the judgement to Aba South Local Government,on seeing the judgement order,the TC Chairman,Dr NCNC Okoli immediately convened an emergency Finance and General Purpose Committee,F&G,PC  meeting and after which, decided to obey the court order through a letter of Memoradum of Understanding duly signed by the TC Chairman to enable the Revenue Consultant implement the contract agreement without any harassment and intimidation by the Council any more.

But however,on assumption of office as the TC Chairman on December 2019,Hon Cherechi Nwogu has continued to flout the court  judgement order by  sending his staff to go to the field to collect tolls from the same contract the Council entered with Chicotas.

The TC Chairman was also accused of awarded same contract  which is yet to expire to other contractors in flagrant disobey of Court Judgement order and Contempt of court order duly served the Council under him.
Meanwhile,when contacted on telephone for his comment,the TC Chairman, Cherechi Nwogu said that the matter is before the court and cannot comment further on it.

But this argument was dismissed by the Counsel to the plantiff,Barr  OC Odionye who said  that there was no motion before the court filed by the defendants, adding that the TC Chairman is only trying to frustrate his client from executing the Court Judgement order till his tenure will be over.

Meanwhile,the immediate past Predecessor to the current TC Chairman,Dr NCNC Okoli on telephone interview admitted that the Council under him signed the agreement and issued a letter of acceptance of Court Judgement order to the Company and wondered why Cherechi Nwogu should not obey the court order.
